He gave 2 options 1. speeding or 2. improper driving. I advised my client to take the speeding. Although both are traffic infractions and the difference may appear indistinguishable, the difference becomes apparent if my client were to be charged in the future with another criminal traffic charge. Troopers/officers don’t charge drivers with improper driving. Instead, improper driving is a form of judicial relief where a judge or commonwealth attorney (prosecutor) reduce it from reckless driving.
As such, if my client were to have picked the improper driving option and then later gotten another charge for reckless driving, the next judge would know that my client had a previous reckless driving charge and was given a break and so that judge may be hesitant to allow for another break. Opting for a speeding infraction masks the fact that the original charge was reckless driving.
